On Friday, the U.S. Court of Appeals for the Sixth Circuit reinstated the Biden administration’s vaccine mandate for employers with 100+ employees, Reuters reported.
The mandate was suspended in November after the 5th Circuit Court of Appeals ruled that it represented an overreach by OSHA. The case was then referred to the 6th Circuit Court. In reversing the suspension, the judges for the 6th Circuit Court wrote:
“It is difficult to imagine what more OSHA could do or rely on to justify that workers face a grave danger in the workplace. It is not appropriate to second-guess that agency determination considering the substantial evidence, including many peer-reviewed scientific studies, on which it relied.”
At least three new petitions to block the mandate have already been filed with the U.S. Supreme Court.
