OSHA has suspended its enforcement of Biden’s vaccine mandate for employers with 100+ workers. The agency website says: “While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.”
The mandate was temporarily stayed by the U.S. Court of Appeals for the Fifth Circuit on November 6, and on November 12 the court voted to continue the stay.
Close to three dozen legal challenges to the mandate have been filed claiming that the law is an overreach by OSHA. The case will now go to the Court of Appeals for the Sixth Circuit, which was selected at random. Experts believe that no matter what happens next, the case will likely be appealed all the way to the Supreme Court.
